Wrongful Death
Wrongful death refers to a lawsuit which alleges that the victim was killed as a result of the negligent conduct or misdeeds of another. A wrongful death lawsuit sounds in tort, and in common law jurisdictions such an action would be traditionally brought against a person who negligently, recklessly or purposefully caused, in whole or in part the death of another person. A defendant can be held liable by preponderance of the evidence for the wrongful death of another even if there was no direct intention to kill the victim. Usually, to be successful in such an action, the plaintiff must prove the defendant was negligent or strictly liable for the victim's death.
